What it costs to register a trade mark in Spain and the EU

The figures below are official fees, not a quote. An attorney's professional fees are separate, and it is better that they stay separate.

Spain: the OEPM

These are the fees in force since 1 April 2026 for a national Spanish trade mark application. Filing electronically is always cheaper than on paper.

A Spanish mark in a single class, filed online, therefore costs €127.88 in fees. In three classes, €293.56. Registration lasts ten years from the filing date and is renewable for equal periods.

European Union: the EUIPO

An EU trade mark covers all twenty-seven member states with a single application. Its fee structure is different: the second class is cheap and the third gets expensive.

The basic fee must be paid within one month of the EUIPO receiving the application, and the file does not move until the payment arrives. Registration lasts ten years and can be renewed indefinitely in ten-year periods.

The comparison that matters

A Spanish mark in one class costs €127.88 and protects in Spain. An EU mark in one class costs €850 and protects in twenty-seven countries. If you sell only in Spain and do not plan to leave, the national route is the proportionate one. If you sell online across Europe, the EU mark works out at just over thirty euros per country.

What the price does not change is the risk: filing does not guarantee registration, and the fee is not refunded if the mark is refused or if someone opposes successfully. That is why checking beforehand is not an optional expense: it is what stops you paying a fee you are going to lose.

How long it takes

In Spain, with no oppositions or objections, the maximum term is twelve months from receipt of the application; in practice it tends to run between eight and fourteen. With an opposition or a suspension, the maximum rises to twenty months.

Is the fee refunded if my mark is refused?

No. Application fees are not refunded on refusal. At the EUIPO a refund is only possible if you withdraw the application before or on the same day you paid the fee.

Can I cover several classes in one application?

Yes, at both offices, by paying for each additional class. Choosing the classes well is what most shapes the protection you end up with.

How long does protection last?

Ten years, renewable. In Spain it runs from the filing date.
